THOMAS TO APPEAL To Supreme Court. Elmore Lyncher Pleads Lack of Proof. Special to the Birmingham News. Montgomery, Ala., Nov. 19.-Next Thursday attorneys for John Thomas, of Elmore county, will submit to the Supreme Court of Alabama an appeal from the decree of the Elmore County Circuit Court that Thomas be sentenced to ten years for complicity in the lynching of Robert White, a negro near Wetumpka last summer. It will be remembered that John Howard, of Elmore county. was convicted of leading the lynching party and was sentenced to imprisonment for life. John Thomas and other white citizens were convicted along with Howard and sentenced to ten years each. Colonel Thomas L Bulger and W. M. Lackey, of Dadeville, represent Thomas. Colonel Bulger said that the Thomas appeal will be argued and submitted to the Supreme Court Thursday. He and his associate will contend that Thomas was convicted upon insufficient proof. He said they would be able to show that Thomas had no part in the lynching of the negro or the conspiracy that led up to it.
