EX-DEPUTY ON STAND IN DEATH OF A NEGRO Special to The New York Times MONTGOMERY, Ala., April 11-Harvey King Conner, a for- mer deputy sheriff on trial in Federal court here in connec- tion with the death of a Negro, testified today that he used only enough force to protect himself while arresting the man for "highway intoxication" last Nov. 20. Mr. Conner testified he struck James Earl Motley twice with a flat leather thong, known as a slapjack, when Mr. Motley grabbed his shirt collar and re- fused to let go. Two Alabama state troopers had testified that the Negro had fallen to the ground under Mr. Conner's blows and that the deputy had continued beat- ing him. The troopers said they had not seen Mr. Motley attack Mr. Conner. Mr. Conner is charged with depriving Mr. Motley of his civil rights while acting under color of the law by making an unpro- voked attack upon the prisoner. The charge carries a maximum of a year in jail.
