- Witness lives in Tuscaloosa; linows Randolph and Eddins; saw them in a fight, on the 28th of March last, near Kirkman and Andrews's store, in Tuscaloosa; heard a pistol fired on that occasion; didn't see it fired; Randolph fired it; Eddins advanced towards Randolph with a stick in his hands raised; Randolph got out n. knife and opened it; by thant time Eddins had reached Randolpb; Eddins struck at Randolpli with his stick; Randolph dodged tho blow; Eddins stenck at Randolpli a second time, and Randolph warded off the blow with his arm; thon they clinched; thinks Randolpli cut the negro; Eddins avas trying to strike Randolpli all the time; don't know which of the parties left first; Randolph went towards his offico; Eddins struck tho-first blow; Eddins struck twico, the first blow was dodged, the second caught on Randolph's arm; Eddins had been in a fight with Hollingsworth im- mediately beforo the difliculty with Randolpli; Eddins advanced on Ran- dolph with a large hickory stick, grasped by thi small end with both hands, and raised in a thirentening manner over his right shoulder ; didn't seo Eddins fall; don!t know what caused him to fall ; Eddins walked about fifty steps from where ho yas cut beforo he fell ; Randolph had gone across the streot in an opposite direction beforo Eddins fell ; don't know how far it was from Randolph to Eddins when the latter fell Eddins walked from near Kirkman & Andrews to Fostor's corner before ho fell; it is about 40 steps from K. & A.'s store to Foster's corner ; tho bill from Randolpli's pistol struck the wall ten or twolvo feot from the ground; saw Randolph about the time Eddins fell ; he was then about 40 *steps from Foster's corner. The next question asked by the counsel for the defense was this - "Did you hear Randolph say at or soon after the difficulty anything going to explain the cause of his firing the pistol qui This was objected to by the Judge Advocate. The objection was sustained on the ground that the words "soon after" were too indefinite. Three o'clock having arrived, the Court adjourned till 9 o'clock this morning.
