Daniel Hays, charged with the shooting of a negro at Fleetwood several months ago and indicted later for manslaughter, was indicted for manslaughter in the second degree by the grand jury which was recessed yesterday afternoon. Arraigned this morning, his trial was set for Tuesday of next week.
Jeff Franklin, charged with assault with intent to murder, was also arraigned this morning and his hearing set for Tuesday of the coming week, as was Will Johnson, charged with a similar offense.
Eugene Moore, charged with grand larceny and false pretenses; Johnie Crittendon, charged with burglary and grand larceny; Phares McPhater, charged with assault with a weapon, and Johnnie Jones, charged with assault with a weapon, were all arraigned this morning and their hearings set for Monday of the coming week. Other cases set for hearing Tuesday include on in which the charge is grand larceny, one in which the charge is disposing of mortgaged property, and five in which the charge is distilling.
The Hays shooting and Fleetwood grew out of a dispute over the possession of a job at the mine, the white man having succeeded a negro who is said to have left the job because of rain. It is said that the negro, returning, claimed the job. Hays procured a very small bore shotgun and fire upon the negro with a charge of squirrel shot, striking him at about the belt.
