- Civil Rights Complaint Is Filed MONTGOMERY, Ala, (UPI) -The federal government filed a civil rights complaint Tuesday against former Deputy Sheriff Harvey Conner in the death of a Negro prisoner in the Elmore County Jail. The Justice Department took the action after the county's grand jury adjourned without returning any indictments in the death of James Earl Motley, 27, last Nov. 20 at Wetumpka. A federal court bearing on the complaint, which charges Conner with violating the civil rights of Motley, was set for March 1, The charge carries a maxi- mum penalty of $1,000 fine or one year in jail, or both, upon conviction. Motley, a construction worker, was found dead in his cell a few hours after his arrest by Conner on charges of resisting arrest, interfering with an officer making another arrest and highway drunkenness. An autopay showed Motley died of "three forceful blows on the head" which caused brain damage.
