- Dan HiggB. GUS Dwizht and .Tohn Shackleford, alleged to have been removed from Jefferson Cnnntv ai-o shown to have been arrested by J. F. Dexter, acting deputy for Mr. Latham. Felix Rutledge, alleged to have been removed from Perry County is shown to have been arrested by Sheriff Latham himself. In the case of Will Redd and Jonse Honeycutt. removed from Jefferson County, each was convicted, Judgment confessed for fine and costs, exe cutions regularly issued and returned "satisfied in full," but the removal fees have never been paid into the State Treasury. Frank Saffold. for whom the expense of removing him from Jefferson County was collected, had been previously carried there for safe keeping from the jail of Bibb County, hence me eApeiise snuuia nave oeen collected from the county treasury. The bills tor removing joe Glover from Dallas County and Enoch Grimes from Jefferson County have attached certificates irom tne erk of the circuit court, snowing that cases were pending asainsi eacn in mat court and the order of removal by the judge makes me same statement, when in fact there were no such cases pending. In the matter of solicitors' fees: Sam jaies ana James Edwards were convicted, judgment confessed for fine and costs, and execution regularly issued but no returns were ever made of the executions. In one case against Steve t-nce tne sheriff s execution docket shows that a levy was made but no sale took place because there was not sufficient time, and no other return was eer made. In the other case against Steve Price, the docket shows satisfied in run. itenfro Brown was convicted and pending the Judgment of the court he escaped through the negligence of the sheriff. I am Informed that ex-Sheriff Latham does not now reside In Blbb County nor in the State, and did not see him In person. A copy of this statement was mailed to his address at his supposed post office, and also a copy furnished to the securities on his bond. I have heard nothing from Mr. Latham. Mr. Latham's fee book does not show all the fees charged and collected by him, as required by section 1364 (3676) of the code. Section 1363 provides that "No clerk, register .or sheriff shall de mand or receive a fee, not Justified by a cnarge enterea in nis lee book."
