- BIRMINGHAM, Ala. - Harvey Conner, a white former deputy sheriff, has been accused by the Justice Department of having beaten a Negro, James Earl Motley, who died in jail on Nov. 20 in nearby Wetumpka. The department acted after a grand jury failed to return an indictment against the former sheriff. Conner faces a maximum penalty of one year in jail and $1,000 fine if he is found guilty of the govern- ment's charge. The charge is based on a federal "color of law" statute, one of several civil rights laws passed. by Congress during the Reconstruction Era.
