- Correspondence between Gov. Lindsay b and Judge Busteed. EXECUTIVE DEPARTMENT, MONTGOMERY, ALA, June 5, '72. II n. Richard Busteed, Judge of the c District Court of the United States, etc. : SIR: From a communication officially addressed to me by the Sheriff of Elmore county, in this State, and here- with submitted to your consideration, it appears that, on or about the 2d day of April, 1872, and pursuant to a war- rant issued by a lawful officer, three persons, to-wit: William M. Smith, William Pylant, and John Holley, d were arrested and lodged in the county jail of said county of Elmore, charged with the crime of murder, alleged to t have been perpetrated by them, on or th about the 18th day of March preceding; that, on the 4th day of April, the grand jury of said county found and h returned to the Circuit Court, then in session, three bills of indictment a against each of the said prisoners, tl charging them with the crime of murder, arson and assault with intent to th murder; that the prisoners were arraigned on said indictments, but, on of account of the expiration of the term tr of said court, the cases were continued in by operation of law, and the prisoners e remanded to jail and the custody of al said Sheriff. It further appears that, of on the 6th day of April, 1872, and in id the most extraordinary and singular manner, the said prisoners were forcibly taken from the custody of the said Sheriff by a Marshal of the United States, and by him committed to the m county jail of Montgomery county, to m answer for an offense against the laws du of the United States.
