- The jury in the ease of the Elmore pri-, soners, Bozeman, Pylant and Smith, sent, word into the court room, to Judge Bus-, steed, yesterday morning, that they desir-, ed to see him. Judge Bustred informed, the counsel of the application made by, the jury, and it was agreed that the jury, should come into the court room and, make such communication as they desir-, ed to Judge Busteed. The jury desired, to know if they could render n verdict as, to one of the prisoners, apart from the, others, and were informed by' his Honor, that they could render a verdict of not, guilty apart from the others, and that, if, they could agree upon such a verdict as, to either of the prisoners, it was their duty, so to do. The jury returned to theirroom,, and in a few minutes thereniter brought, in a verdict of not guilty as to Browning, Bozeitian, and the Judge ordered that, Bozeman be at once discharged from cus-, tody. It will be remembered that Hon., N. F. Rice was counsel for Bozeman, and, his efforts, able as they are always, lus, resulted favorably to his client.-{Monf., Journal, 13th.
