NEGRO ON TRIAL, FOR MURDER OF, BROWN HORTON, Frank Richardson Faces Trial in Two, Cases, TRIAL TO BE CONCLUDED, IN VERY SHORT TIME, Defense Pleads Guilty To Manslaughter But Not Guilty To Murder as Charged. At 12 o'clock the jury was selected in the case of Frank Richardson, the negro charged with the murder of Brown Horton. This case is being tried first, the case growing out, of the killing of Tom Cooper will be, taken up later., The following men compose the jury: J.F. Alston, W. S. Patton, R., E. Hobson, Richard Marlowe, John, D. Blocker, Jr, A. M. Mills, A. F, Ramsey, David Roberts, C. A. Harris., L. C. Bell, J. C. Wheat, J. M. Hays. As soon as the jury was selected, the trial began. The state put on, the stand five witnesses, members of, the pursuing posse on the night Brown Horton was killed. On account of the darkness during the, night none of the witnesses positively identified Richardson as the man, seen on the night of the killing. The, witnesses examined were Sheriff W. C. Palmer, Deputy Hamby, Mr. Fletcher Powers, Mr. Peck Connell, and Mr. F. Robertson. The witnesses testified to seeing a man in the, vicinity the night of the killing and, saw Horton when he was shot., After their testimony court adjourned until 2:30 o'clock. The defense entered a plea of, not guilty to the charge of murder,, but plead guilty to a charge of manslaughter. The defense will place, character witnesses on the stand before the case goes to the jury. Whether Richardson himself will testify was not stated. Frank Richardson, a negro, was, arraigned in the County court Wednesday morning on two charges of murder in the first degree. Richardson killed Tom Cooper and Brown Horton, two well known Tuscaloosa men several weeks ago, and made a confession when captured. The killing of Cooper occurred on, S, Sunday morning, and Horton, who, D, was in the pursuing posse, was killed, at an early hour Monday morning. The entire morning was taken up in selecting the jury. The defendant, was represented by Messrs. Rice and, Vandervoort, and the state by Messrs., i, Oliver, Verner and Rice. Judge H. B. Foster presided. The indications are that the trial will be brief, and few witness will be examined. The case may go to the jury Wednesday night.
