As governor, O'Neal was hampered by a legislature marred by thefts of public monies occurring within the state Convict Department, headed by James H. Oakley, and within the Department of Agriculture. Minor officials in both departments were tried, sentenced and served terms in prison for their crimes. Oakley was tried and found not guilty on the charge of misuse of state funds.
