The Governor's Secretary writes to the Demopolis Republican defending His Excellency against the charge of abusing the pardoning power, and explaining particularly the pardon of PERRAS. Of this particular case, Mr. Dalton says: -- "After a careful consideration of the case, the Governor granted a pardon, stating, however, upon the face of the pardon warrent, that it should only take effect when PERRAS left the State, and that it should be forfeited if he ever returned to it. In other words, the punishment was commuted from ten years service in the penitentiary to perpetual banishment from the State." The Selma Argus wants to know where Governor Smith gets the power to punish citizens -- to commute, if he pleases, a punishment prescribed in the statutes to one unknown to the laws. If PERRAS was guilty, why was he pardoned? If PERRAS was innocent, why was he banished?
