(Peters, J.) Held 1st. An application for a change of venue in a criminal case, setting forth specifically the reason why" the applicant "cannot have a fair and impartial trial in the county in which the indictment is found" should be granted by the Court, if within the proper time and in the proper way. This is a right which will be enforced by mandamus if it is refused and denied. (Rev. Code § 4306.).
