Talladega County
To his Excellency A. B. Moore
Gov of the State of Alabama
Your Petitioner Reuben J. Goode a citizen of said County respectfully shareth unto your Excellency that some time the year of 185[torn off] your Petitioner became the executive of one [torn off] Garden for his appearance at Court, said Garden having been previously indicted in said court for a misdemeanor. That your Petitioner in discharge of his undertaking sent said Garden to the trial [leave?] of said in-dictment + is informed + believes that said Garden was present when said case was called for trial, but from ignorance fault to answer when called. That said circuit court [endured?] a judt<u>[niei?]</u> upon said undertaking that [suufacia?] [an y?] [puud?] upon said judt[niei?] the fall term of said Court said [judt?] was made absolute -Your Petitioner further show that said Garden [opposed?] in answer To said indict-ment at -every tum after said for future was taken and that at the last term of said Circuit Court said mistreatment was [nol profect?] -The conservation of the forgoing fact -your Peti-tioner praise your Excellency to enact said five of two hundred dollar in as much as his [co-executive?] on Joseph Stomaphin + the said Asa Garden are wholly in solvent and your Petitioners will ever pray [rd?]

I presume the facts are as stated in the petition, and have no doubt that Gardens ignorance (for he is very ignorant) was the reason of the forfeiture and of the final judgement. Mr Goode is one of the honest yesmen of the country, + would not have connived at Gardens evasion of punishment for any violationof law. He was indicted for trading with a slave: The indict=ment was not proper at the last term. I think tis’ a proper case for Executive Clemency
