Goodwin was convicted at the last term of the Circuit Court of Montgomery County of man-slaughter in the second degree and fined five hundred dollars and imprisoned twelve hours. And bring unable to pay the five was sentences to six months imprisonment in the County jail as assigned by statute. The entire jury having petitioned and a large number of good and worthy citizens having petitioned to have said five and imprisonment remitted and it bring made to appear to me that a verdict of [civilly?] would not have been formed by the jury except by way of compromise with a view of preventing a further continuance of the case the lesser and having already been imprisoned for a long pace of time and his general health hereby greatly impaired. It was considered by the jury to continue him in im-prisonment six months longer might permanently impair his general health. six of them who believed him not guilty consented to under the verdict as shown. Believing with the jury, that his guilt was doubtful and that his long imprisonment which he has already suffered taking into consideration the conditions of his health, entitles him to executive clemency, I therefore determine to release him from imprisonment and [remitt?] said fine, and order that he lie discharged on the fist day of September next.
