To His Excellency [[Moore, Andrew B. (Andrew Barry) 1807-1873|A. B. Moore]], Governor of the State of Alabama.
The Undersigned respectfully show unto your Excellency, that [[Waugh, Arthur, 1866-1943|Arthur S. Waugh]], of the [[Mobile (Ala.)|City of Mobile]], was indicted before the City Court of Mobile, under Section 118, and 127 of the Code, for failing to give Bond as a [[Notary publics|Notary Public]] duly commissioned by the Governor of the State of Alabama, during the year 1856.
That upon the trial of the said [[Indictments.|indictment]], the said Arthur S. Waugh admitted the facts set forth in said indictment and, but the consent of the [[Solicitor|Solicitor]], and, with the permission of the Courts, made a statement of the facts, and circumstances which led to his omission, and failure to give the Bond, required of him by Law.
That from said statement the Undersigned feel satisfied that said omission did not result from any intention on the part of said Waugh to violate the law, but that it naturally arose from the circumstances detailed by him.
That said Arthur S. Waugh is a Marine Notary, of the City of Mobile, his business being confined to that branch of the Notarial business, and there was no evidence that by reason of his failure to give his Bong, any person, or corporation had been injured – or, that his duty, as a Notary, had been in any respect, violated.
The Undersigned further represent that as members of the Jury who tried the case, they felt themselves bound, under the law, to return

Return a [[Verdicts.|verdict]] of “Guilty”, and assess the fine at Five Hundred dollars, the sum fixed by the law – but, at the same time they felt that the punishment was altogether disproportionate to the offence in this case, especially as the defendant is wholly dependent on his business as Notary for this support of his family, and that so soon was notified, he attempted to repair his neglect by offering indoubted security – that he promptly gave bond under the Commission granted to him by your Excellency – In view of the fact that no private injury was inflicted, and no public good will be subserved by exacting the fine imposed, the Undersigned respectfully request that your
Excellency [?] remit the same.
