On this the 28<sup>th</sup> day of February A. D. 1859 before me, personally came [[Morley, George|George Morley]] and [[McLeane, James|James McLeane]] who being duly sworn depose and say that they are well acquainted with [[Banta, J. H|J. H. Banta]] and have known him for years and have always found him a good and law abiding Citizen. That they are satisfied that the said J. H. Banta, at the time that he bet[[Gambling|gambled]] at ten [pairs?], (for which offence he is now confined). had not the slightest idea that it was illegal. The publicity with which he did it in an alley within a hundred yards of the City Police office, the fact that heretofore [it?] has always been permitted— and his statement to affiant since, satisfy them beyond a doubt that J. H. Banta was not aware when he so bet as new fines that he was doing an act prohibited by law—

Bantu who was commuted other one city court of Alabama^for[unclear]^ [remitted?] on the payment of the costs [which?] he [ground?] [most?] now feel- a ten pair [without?] [unclear] at non a violation ^of law^ is [biny?] a recent statute of which he had no knowledge- of this fact I am [assured?] by the letter of [Scheelor?] [Amitend?] & affiant filed
