From the Alabama Department of Archives and History Governor A. B. Moore Collection. A sworn testimony by James J. Byneen that confirms that James Mclean had told him of the alleged theft of his pocket book by Jacob Parmer. Note that Byneen states that he did not witness the event, only Mclean talking about the alleged crime.

Before me [[Locke, William H.|William H. Locke]] Clerk of the [[Circuit Court|Cir—cuit Court]] honorably came [[Byneen?, James J.|James J. Byneen?]] who being duly sworn [in good faith?] that about the first of the year 1858 affiant and [[McLean, James|James McLean]] were coming from [[Eufaula (Ala.)|Eufaula]] together when the subject of the indictment of [[Parmer, Jacob|Jacob Parmer]] for [[Larceny|Larceny]] of the Pocket of said [[McLean, James|James McLean]] from the [unintelligible], having been mentioned said [[McLean, James|James McLean]] said he had sworn once that said [[Parmer, Jacob|Jacob Parmer]] had taken his Pocket Book — that he did not know whether [[Parmer, Jacob|Jacob Parmer]] had done so or not but that he ( [[McLean, James|James McLean]] ) had sworn so once and he would <s>so</s> it again
