To His Excellency, the Hon [[Moore, Andrew B. (Andrew Barry), 1807-1873|A.B. Moore]] Governor of the State of Alabama:
1. The humble petition of [[Walterman, Nathaniel N.|Nathaniel N. Walterman]] respectfully showeth unto your <s>Honor</s> Excellency, that at the Spring Term of A.D. 1860, of the [[Circuit Court|Circuit Court]] in the [[Henry County (Ala.)|County of Henry]], and State of Alabama, there was pending an Indictment against your petitions, and [[Hays, James|James Hays]], [[Chester, Martin|Martin Chester]], [[Chester, Mac|Mac Chester]], [[Matthews, Levi P.|Levi P. Matthews]] : [[Murray, Joseph|Joseph Murray]], [[Moe—leman?, Thomas|Thomas Moe—-leman?]] and [[Roney, ,John A.| John A. Roney,]] for an [[assault|assault]] on the body of Ms [[Brasswell, Nancy|Nancy Brasswell]]; and that on the trial of said Cause, the jury found your petitioner <u>Guilty</u>, and assessed a fine of Two Hundred Dollars against him; and also found the Co—Defendants <u>not guilty</u> ; all of which will, <s>He</s> here fully appear, from the [unintelligible] of said Case hereto appended and marked “A.”
2. That on the trial of said Cause the said Ms [[Brasswell, Nancy|Nancy Brasswell]], and two of her daughters, Lower: [[Brasswell, Marth Ann Eliza|Martha Ann Eliza Brasswell]], and [[Braswell, Casey|Casey Brasswell]], were sworn and examined as Witnesses, in said Cause, in behalf of the State: and that the said [[Brasswell, Nancy|Nancy Brasswell]], and [[Brasswell, Marth Ann Eliza|Martha Ann Eliza Brasswell]], Each testified on said trial, that

your petitioner entered the House of the said Ms [[Brasswell, Nancy|Nancy Brasswell]], at night, with a gun in his hands, and presented the same at the said [[Brasswell, Nancy|Nancy Brasswell]], which she was in her bed— and the said [[Braswell, Casey|Casey Brasswell]] testified on the said Trial, that she saw your petitioner enter the House of the Said [[Brasswell, Nancy|Nancy Brasswell], but did not see the gun in his hands. All three of said witnesses, testified in said case, that they were in the House, at the time, when your petitioner is alleged to have En—tered, and made the assault with the gun.
3. Your petitioner [unintelligible] unto your Excellency, that it made <u>Solely</u> upon the Testimony of the said [[Brasswell, Nancy|Nancy Brasswell]], and the said Martha Ann Eliza, that the jury found their verdict of <u>Guilty</u> of an <u>[[Assault|Assault]]</u> and assessed the said fine of Two Hundred Dollars against your peti—tioner.
4. Your petitioner now represents and avers, that the testimony of the said [[Brasswell, Nancy|Nancy Brasswell]], and [[Brasswell, Marth Ann Eliza|Martha Ann Eliza Brasswell]], as set forth as above, is false in fact; and your petitioner avows, that he did not en—ter the House of the said [[Brasswell, Nancy|Nancy Brasswell]], nor did

he <s>enter</s> have, or present ant gun at said [[Brasswell, Nancy|Nancy Brasswell]].
5. Your petitioner [requests?] unto your Excellency, that the said Nancy, and the said [[Brasswell, Marth Ann Eliza|Martha Ann Eliza Brasswell]], were on the 17th day of May A.D. 1860, arrested and bound over, to appear at the next Term of the [[Circuit Court|Circuit Court]], in the said County of Henry, under the charge for [[Perjury|Perjury]]; that the said Defendants are never un—der Bond for their appearance at the next term of the said [[Circuit Court|Circuit Court]] for the said County <s>For</s> Henry, and that the [[Perjury|Perjury]], for which they all found over there to appear, were for the false swearing above set forth: all of which will appear, from the Transcript hereto appended marked “B.”
6. Your petitioner never having fully set forth all the facts, connected with the history of the finding of your petitioner guilty of the [[Assault|Assault]], and the iss—uing the said fine of Two Hundred Dollars, and the character of the Testimony, upon which, the jury based their said Verdict, your humble petitioner now prays your Excellency to [revisit?] the fine that impacted, under such cir—circmustances, and your petitioner
