To Hon [[Moore, Andrew B. (Andrew Barry), 1807-1873|A.B. Moore]] Governor of the state of Alabama
The petition of the undersigned citizens of [[Barbour (Ala.)|Barbour County]], respectfully [showeth?] with your excellency that [[Nolin, Elijah|Elijah Nolin]] was convicted at Sprint Term 1859 of assault & battery when the pension of one [[Houston, Edward|Edward Houston]] & fined in the sum of fifty dollars; that said fine was [crossed out] the conviction in the sum of fifty dollars was ^had^ the testimony of Edward Houston alone - that since said[[Trial|trial]] it has been made to appear that said Edward Houston was one of those engaged in or accessory to the murder of [Orr, James|James Orr]] & that now a majority of the citizens of the immediate vicinity as well as of the County would not believe said Houston in his oath: that is was in evidence that nat long preceding the alleged assault & battery said Houghton had offered an indignity to the [[wife|wife]] of said Nolin; but for the reason that no one was present excepting said Nolin & Houston said Nolin was not able to prove the cause of the difficulty as said Hayton would not testi-fy that said indignity was the cause of quarrel; that said Elijah Nolin is a very [[impoverish|poor]] man and that it will operate badly upon him to pay this fine with a large bill of costs unnecessarily produced by said Edward Houston who was prosecutor = For the reasons aforsaid petitioners pray your Excellency to remit said fine & costs and we will ever pray &c.
