Martin Fay was convicted of one against [?] intent to murder one Michael Collins, in the City Court of
Mobile at the Spring Term of said Court 1858
The [?] who came to him, and the officers of the defferent? Court of Moble including [?] [?] of the
Circuit Court $ Many citizens of high respect
Martin Jay/Fay was convicted of an assault with intent to murder one Michael Collins, in the City
Court of Mobile at the Spring Term of Said Court 1858.
The jury who convicted him and the offices of the different Court of Mobile including Judge
[Rasseen?] of the Circuit Court + many citizens of high respectability of Mobile having petitioned me
to remit the balance of his term of imprisonment.
- It appears from the facts stated by the jury that said Fay struck but one blow + deserted, where it
was in his power to have repeated the blows, + to have taken the life Collins. These facts lead my
mind to the conclusion that he was guilty of assault and battery + not of an assault with intent to
murder. It also appears to have been a sudden assault + that the [?] was done in the heat of [?], and
in the moment of excitement. It also appears that his conduct has been good [whilst?] in the
Penitentiary. For these reasons, I have determined to remit the balance of the term of his
imprisonment & to take effect on the first day of September next.
