[[Smith, Joseph|Joseph Smith] a citizen of [[Cherokee County (Ala.)|Cher-okee County]] plead guilty at the late Fall term of our Circuit Court to [?] indictment - for soliciting [courtrecords?] [?] -and was find twenty dollars in each case. The selecting was by the [quest?] + the [officer?] [?] to in it - being [?] "<u>on or about</u>" the premises - This he alleges ^ we believ is true. He [does?] in ignorance of its being in violation of law. Mr Smith has always sus-tained the character of a quiet, peacable, lawbiding citizen - this is his first + only offense of which we have any knowledge _ we have known him for years. He is not + never has been, so far as we know or believe in the habit of keeping liquors for sale in any quantity. He is poor + has a [[Family|family]] [?] where his labour for a support. [He?] [each?] [incdedent] to the two prosecutors amount in the aggregate to about sixty dollars [?] each he will have to pay - to [pay?] which + then [finish?] in each case he will have to make a sacrifice of his homestead for he has no <s>[other?]</s> properly [face?] from the [?] [lawn?]. He will give up all before his friend shall suffer. [Here?] we think under the [current?] [sta?] will be a punishment too severe. In consideration of the premises, we respectfully ask your Excellency to release him from the [fines?] aforesaid - we believe he [somberly?] [regrets?] his error and we believe he will never be quietly of a [restituion?] of the said offence. [neccesary] of us [?] his immediate [neighborhood?]

Joseph Smith has indicated their [considerations?] in the [?] at the late Term of the circuit court of Cherokee county for [?] [?] [?] + [fined?] [?] [?] in each case [?] The [?] of the [?] [?] + [?] I have [?] to [remit?] all [?] for [dollars?] of the [fence?] in which case, the [?] the Shff of said county is [?] the [?] whom the payment of five dollars the cost in each case
