Before me [[Hothclaw, James L|James L Hothclaw]] an acting Justice of the peace in + for said county personally appeared [[Sanford, Henry|Henry Sanford]] who being duly [?] on [satch?] says that Nathan [alias?] [[Masoney, Nathaniel|Nathaniel Masoney]] was the agent of the Adams [Sheep?] Company a joint stock association or company [organized?] and doing buisiness as such and by said name [inorder?] the Laws of the State of [[New York|New York]], And that said Masoney was said agent of said Company in the [[Montgomery (Ala.)|City of Montgomery]] and County + [that?] aforesaid on the 26<sup>th</sup> day of January 1859. And so Continued and remained [until?] the 30<sup>th</sup> day of January 1959 in said City and Couty and during the [period?] aforesaid from said 26<sup>th</sup> to the 30<sup>th</sup> day of January 1859. the said Masonry as said against of said company recieved to be forwarded to their destination and from the following [persons?] to be forwarded by the said company to the following persons [form?] packages of Bank Bills_ to lent: one package of Bank Bills of the amount of Seventy Five Hundred doll-ars from John Henly + Company to be forwared + delivered to W. L. Breese at [[Charleston (S.C.)|Charleston South Carolina]] and of the value of twenty five hundred dolalrs. One package of bank bills of the amount and value of thirty thousand dollars from the Central Bank of Alabama to be forwared and delivered to M. Hatch at [[Augusta (Ga.)|Augusta in the State of Georgia]]. One package of Bank Bills of the amount and value of five thousand dollars from Josiah [Mor?] to be forwarded and delivered to [[Craig, John|John Craig]] at Augusta in the State of Georgia. And one package of Bank Bills of the amount and value of twenty five hundred dollars received and from the Bank of Montgomery to be forwarded and delivered to [[Davis, J. W.|J. W. Davis]] at Augusta in the State of Georgia, all which packages of Bank Bills were recieved by said Masoney in the said City and County of Montgomery by [Austin?] of his said Employment as said agenty of said Company and that said Masoney which said packages of said Bank Bills were in his possession as said

agent [[Embezzlement|embezzled]] or fundamentally converted the said Bank Bills to his own use - and that said Masoney is not an apprentice [his?] is he under the age of Eighteen years surmount and [subsenlied?] before me this 31<sup>th</sup> day of January 1859. [Jas?] P. [Hottclaw?] J. P. [reasoned?] + [resulseled?] after changing the name of Brewer to Breese in [body?] of affidavit this 4<sup>th</sup> of July A. D. 1859

Hubbard]] clerk of the Circuit Court for said county do hereby [ca?] that the forgoing is the copy of the affidavit made in the case of the State of alabama atgainst Nathan alias Nathaniel Masoney returned into this office by James P. Holtclaw a justice of the Peace of the said County as the same remains of file in my office.
In testimoney where of I have [?] set my name + affixed the seal of the said court at office this tenth day of May A. D. 1859.
