In the letter, McIlwain, described as the "only lawyer in Bibb," discusses a recently vacated judgeship, created by the incumbent Porter King joining the Confederate army, and if Governor Moore will agree to appoint someone else to the position.

Ala Sept 24 - 1861

G. W. Gagle Esq

Dr sir:

Your favor of the 19th
inst came duly to hand & in reply I will
say to you - that it will afford me much
pleasure to give you my aid in ob-
=taining the office - Ascertain for
certain that King has resigned & also that
Moore will appoint & then without
delay I will Comply at once with
your request. I wrote him two let=
-ters to learn whether or not we would
have Court - or in other words whether
or not he would appoint a [judge?] &
he write back to the Clerk that
the "Hon Porter King is now in
the army & that there will be no
Court". I don't understand this & shall
not write any more to him about
Court unless I know he will make
an appointment &c I will just say
here that our Clerk is a very intelli=
-gent gentleman - & I presume he was
aware of all the facts that his exce
-llency informed him of - Truly
