A typed Commision to take deposition to Samuel Leeper and N.B. Mardis. Leeper and Mardis are named as the commissioners who will examine J T Leeper, Rich H Brasher, Wilie H Pope, and Willis M Pledger. The case is a contest from two men against the right of two delegates to their seats in the Convention of the People of Alabama as delagates from Shelby.

COMMISSION TO TAKE DEPOSITION.

THE STATE OF ALABAMA, SHELBY COUNTY. TO Samuel Leeper & N B Mardis

KNOW YE that we having full faith in your prudence and competency, have appointed you Commissioners, and by these presents do authorize you, or any either or more of you, at such time and place as you may appoint, to call before you and examine J T Leeper, Richd H Brasher, Wilie H Pope, & Willis M Pledger as witnesses in behalf of contestants in a case pending in our Circut Court for Shelby county, Alabama, wherein in & before the Convention of the people of the state of Alabama now in session in the city of Montgomery in said State in which case John R Kenan & John H M Welch are are contestants & John M McClanahan & George D Shortridge sitting mem =bers of said convention are contestees, said case being a contest by Plaintiff said Kenan & Welch of the right of said McClanahan & Shortridge to seats in said Convention as delegates ffrom the county of Shelby in said state, Defendant on oath to be by you administered, upon interrogatories annexed to this Commission; to take, reduce to writing and certify the deposition of the witnesses, and return the same to our said Con= =vention Court, with all convenient speed, under your hands and seals.

WITNESS WILIE H. POPE, Clerk of the Circuit Court ^of said County of Shelby, at office, this 25th day of January A. D one thousand eight hundred and fifty sixty one Wilie H Pope CLERK, &c. Issued the 25th day of January 1861.
