Came before me Wilie H Pope Clerk of the circuit Court of the County aforesaid William R Porter & S Leeper & A Garrett and acknowledged themselves security for the costs of the contest of the election of John M McCanahan & George D Shortridge as Delegates from the county of Shelby to the Alabama State Convention to convene in Montgomery on Monday The 7th of January 1861 Said contest is instituted by John R Kenan & John F M Welch and we acknowledge ourselves their securities for the costs of such contest. Came before me Wilie H Pope Clerk of the circuit Court of the County aforesaid William R Porter & S Leeper & A Garrett and acknowledged themselves security for the costs of the contest of the election of John M McCanahan & George D Shortridge as Delegates from the county of Shelby to the Alabama State Convention to convene in Montgomery on Monday The 7th of January 1861 Said contest is instituted by John R Kenan & John F M Welch and we acknowledge ourselves their securities for the costs of such contest. I Willie H Pope Clerk of the Circuit Court of Shelby County Alabama do hereby certify that the foregoing on this page is a true copy of the original obligation of security for costs filed in my office on the institution of the contest by John R Kenan & John F M Welch of the election of John M McClanahan & George D Shortridge
John R Kenan & John F M Welch present & state that they are qualified electors of the County of Shelby and State of Alabama and were such on & before the 24th of December 1860.
2nd They present & state that on the 24th of December 1860 an election was held in the county of Shelby to elect Delegates to the Alabama State Convention to be held in Montgomery to Convene on Monday the 7th January 1861.
The said Kenan & Welch further present that George D Shortr= =idge and John M McClanahan have been certified by the Sheriff of Shelby County as having received the two highest number of votes at said election which certificate is incorrect in this that it does not embrace the returns from Precinct No 11 in said county & the said Kenan & Welch contest the election of the said John M McClan= =ahan & George D Shortridge as Delegates to said convention upon the Ground that seventy seven votes which were given to the said John R Kenan and seventy seven votes which were given to the said John F M Welch for Delegates to said
convention were not included in the count of votes by said Sheriff for the said Kenan & Welch, They further present that at the other precincts in said County except Precinct No 11 that the said Kenan re= ceived 588 votes and the said Welch received 576 votes, and that the said McClanahan at the other precincts besides precinct No eleven received 635 votes and the said Shortridge received 627 votes and that at precinct No (11) eleven in said county at said election the said Kenan & Welch each received 77 votes and the said McClanahan 6 votes and the said Shortridge 6 votes. And the said Kenan & Welch contest the election of said McClan =ahan and Shortridge upon the ground of the rejection of said votes given at Precinct No (11) eleven at said election, and say that they the said John R Kenan & John F M Welch were legally elected at said election held in said County on the 24th of Decr 1860 Delegates to said State convention.
